March 27 2008, Kaos Radio 90.5 FM is being blocked from its new tower site at 1001 Talwood Drive. This despite the fact that the project was approved by the CRTC and Industry Canada in August 2007.
The project to move the tower was initiated in May, 2007, and was allowed by the building’s former owners as well as by the new management company Realstar as per an agreement with the Church at Selwyn and the former owner of the property at 1001 Talwood Drive. Kaos Radio was moving forward with plans to construct the tower on the site of 1001 Talwood Drive. However, last September, Kings Kids Promotions, the registered charity that owns Kaos Radio, received a letter from Gardiner Roberts, LLP, solicitor for the new owner of 1001 Talwood Drive, prohibiting the installation of the antenna.
The issue has not been resolved and it scheduled for Ontario Superior Court of Justice proceedings on April 18th in Peterborough to appoint an arbitrator to rule on the access to the site.
While Kaos Radio will be hopefully only temporarily off air in Peterborough, it will continue to stream online at www.kaosradio.com until the tower issue is resolved. “This is a very frustrating set of circumstances,” said Kaos Radio General Manager Rick Kirschner. “We had an agreement in place to construct the new tower and many people in the community have been behind us with financial support to get the tower built.”
Mr. Kirschner believes that the situation will ultimately be resolved in favor of Kaos Radio and King’s Kids Promotions, but until then, “we just have to wait for the arbitration process to run its course.” In the meantime there will be staff lay offs at Kaos. “Our staff has been apprised of the situation,” Mr. Kirschner said. “The staff consists of truly outstanding people who have sacrificed many times over for this station because they believe in what we are doing.”
